正因?yàn)榉膳c道德、法治與德治存在諸多區(qū)別，同時(shí)又有若干內(nèi)在一致的地方，因此依法治國(guó)與以德治國(guó)在功能上是相互補(bǔ)充、相互作用的，在價(jià)值目標(biāo)上是殊途同歸、有機(jī)統(tǒng)一的。法治是社會(huì)主義道德的底線和后盾，凡是法治禁止的，通常也是社會(huì)主義道德反對(duì)的；凡是法治鼓勵(lì)的，通常也是社會(huì)主義道德支持的。社會(huì)主義道德是法治的高線和基礎(chǔ)，是法治具有合理性、正當(dāng)性與合法性的內(nèi)在依據(jù)，法治的價(jià)值、精神、原則、法理等大多建立在社會(huì)主義道德的基礎(chǔ)上，法治的諸多制度和規(guī)范本身是社會(huì)主義道德的制度化和法律化。同時(shí)，法治不應(yīng)當(dāng)規(guī)范和調(diào)整人們的思想意志，對(duì)于思想范疇的問題往往表現(xiàn)得無能為力；而對(duì)于道德淪喪、良心泯滅之徒的行為，思想道德的約束也常常無濟(jì)于事，正所謂“寸有所長(zhǎng)，尺有所短”。所以，我們既要反對(duì)以法治完全取代德治的做法，也要反對(duì)重視德治而忽視法治的傾向。
總之，我國(guó)法治正經(jīng)歷著從形成中國(guó)特色社會(huì)主義法律體系到建設(shè)中國(guó)特色社會(huì)主義法治體系轉(zhuǎn)變、從以立法為中心到以憲法法律實(shí)施為重點(diǎn)轉(zhuǎn)變、從法律大國(guó)向法治強(qiáng)國(guó)轉(zhuǎn)變的戰(zhàn)略大調(diào)整。在前所未有的歷史新起點(diǎn)上全面推進(jìn)依法治國(guó)、加快建設(shè)法治中國(guó)，必須統(tǒng)籌全面建成小康社會(huì)、全面深化改革和全面從嚴(yán)治黨，在“四個(gè)全面”總體戰(zhàn)略布局的偉大實(shí)踐中，不斷開創(chuàng)中國(guó)特色社會(huì)主義法治建設(shè)的新局面。

—The Strategic Planning and Systematic Thinking for Fully Advancing the Rule of Law

Abstract: The overarching Four-Pronged Comprehensive Strategy brings the important position and significance of fully advancing law-based governance of China to the new level of the CPC's and China's general strategic arrangement. Under the Four-Pronged Comprehensive Strategy, the conditions for fully advancing law-based governance of China are that we must adhere to the socialist legal theory, path and system with Chinese characteristics; remain committed to integrating leadership by the Party, the position of the people as masters of the country, and the law-based governance of the country; let the Party lead legislation, ensure law enforcement, support the judicial work and lead the way in abiding by the law; promote the coordinated development of scientific legislation, strict law enforcement, fair administration of justice, and universal law-abidingness; build a rule of law country, law-based government, and law-abiding society; uphold the rule of law, government administration according to law, and law-based governance; and govern the country according to law and high ethical standards.
